I am an expert in civil trial, in practice since 1980 with a Martindale-Hubble AV rating, the highest ranking for legal ability and professional ethics.
Whenever a serious motorcycle accident happens, the motorcycle does not remain upright and of course neither does the rider.
Because the most frequent type of motorcycle accident is one where the car driver pulls out from a stop sign, the accident is either a T-bone or a side impact. In either event, on a cruiser style of bike, the long exhaust pipes may protect the operator in the event of a lay-down but really don't do much at all to protect against the higher front bumper of a car. Which means the basically unprotected legs, ankles and knees can be easily crushed or fractured.
In Florida, motorcycle accidents happen mostly because automobile drivers do not share the road.
The first and most frequent accident I represent seriously injured motorcycle riders for is when a car fails to see the motorcycle and then the car pulls out into the intersection.
The second most frequent is the car driver changes lanes without looking.
The most frequent injuries are fractures of shoulder or wrists from going over the handlebars, or femur (long bone of the leg) fractures from laying the bike down or a side impact.
Unfortunately, even at slower speeds and with a helmet I have represented the family of fathers and sons who have died in motorcycle crashes.
I represented a motorcycle policeman's widow when her husband died due to a drunk driver hitting him on the side of the road while he wrote a ticket straddling his bike.
Even good riding gear and high top biker boots will not prevent crush damage very much. Maybe help with road rash, provide ankle stability and support for everyday use, but really they are not meant for serious protection in a serious accident. Even a helmet has its limits.
If you have a serious leg fracture, there are lots of facts which your motorcycle accident lawyer will need to know about your injuries
For example, is the fracture a clean break, or were there more than piece of leg bone broke? This can make a big difference in the healing time and the eventual outcome. Are you a diabetic? On a blood thinner? Did the fracture happen near the knee or ankle joint? How old are you? Do you have a history f arthritis? If you are a very young rider, is the injury near something called a "growth plate" and if so, have you been recommended by you medical provider to see a specialist to make sure you are not at risk for stunted bone growth?
Maybe your leg fracture needed an external fixation device, with pins sticking outside of you like the neck bolts on Frankenstein. This probably will also make a difference in the value of your motorcycle accident case. If the fracture will cause any long term difference in the way you walk, like maybe a limp in your gait, will it cause your hip to wear out years later down the line?
In my motorcycle personal injury law practice, I know that many of my clients don't want to wait years for a lawsuit to be decided by a jury, and that they would prefer a good settlement if one can happen. Certain types of motorcycle injury cases simply should not be settled immediately, unless there is a limited amount of liability insurance. Not all injuries are sure to heal as you wish or expect they should. What if your case is settled too early?
In a limited number of motorcycle accident cases, as one example of this, a fracture may fail to unite.Which means that the fractured leg bones did not grow back together, they did not fuse. You have to think twice before making a mistake of not waiting for a reliable understanding of the outcome of the healing process in any leg fracture case.
